The Scope of the Return Policy
This Orbitvu Return Policy is for all Orbitvu products (“Product” or “Products”) and/or services distributed and/or provided in the United States by Orbitvu and/or by any of Orbitvu’s authorized resellers and/or service providers (the “Services”) (collectively, for purposes of this Orbitvu Return Policy only, “Orbitvu”).
This Orbitvu Return Policy does not cover defective or damaged Products, the return of which is governed by the Orbitvu Limited Warranty Terms & Conditions, available at: https://orbitvu.com/warranty-terms-and-conditions (“Limited Warranty”).
Customized Products provided by Orbitvu, and/or all Services provided by Orbitvu, including but not limited to, installation, training, and/or technical support, are not eligible for return, credit, offset, or refund of any kind whatsoever by Orbitvu
Purchaser acceptance for any Product and/or Services provided by Orbitvu, including but not limited to installation, training, and/or technical support, occurs at seven (7)days from delivery by Orbitvu.
The Right to Product Return and the Return Period
Purchaser has the right to return Product for a refund (“Refund”) within ten (10) days after the delivery date (“Return Period”) for any reason (except for defective or damaged Products, the return of which is governed by the Orbitvu Limited Warranty).
How to Return a Product
Before returning a Product, Purchaser must first contact Orbitvu customer service at: 470-737-4060 and provide a copy of the invoice for the Product in order to obtain a Return Authorization Number (”RAN”) from Orbitvu. Orbitvu will not accept any return without a RAN.
After obtaining a RAN, the Purchaser shall ship the Product back to Orbitvu at Purchaser’s nonrefundable sole cost and expense.
The Product returned must be in the original packaging with all original items, original equipment, and documentation, all undamaged, in brand new working condition with no alterations to hardware or software, all in Orbitvu’s sole discretion and inspection, and accompanied by the RAN and a copy of the invoice.
If the Product returned does not fulfill these conditions, Orbitvu may, in its sole discretion, either reject the return entirely (at Purchaser’s expense and risk) or accept the return, but reduce the amount of the refund by the value of the missing or damaged items and/or other amounts owed to Orbitvu by Purchaser.
Amount of the Refund, Restocking Fee
Upon receipt and examining of the Product returned, Orbitvu may issue a Refund of the total purchase price actually paid by the Purchaser, reduced by:
- original shipping costs, insurance, and handling fees;
- return shipping costs, insurance, and handling fees;
- rejection shipping costs, insurance, and handling fees;
- all amounts for lost and/or damaged items;
- any fee-based services including installation, training, and technical support;
- a Restocking Fee of twenty percent (20%) of the total purchase price;
- all amounts expended by Orbitvu in the transaction and/or with the Purchaser in any transaction, including but not limited to, reasonable attorneys’ fees and court costs;
- any offsets whatsoever Orbitvu may have against Purchaser; and/or
- all other amounts owed to Orbitvu by Purchaser in this or any transaction.
Refund Processing Time
Returns are typically processed by Orbitvu within ten (10) days of arrival at its warehouse, so long as there are no additional issues. Refunds may be credited towards Purchaser’s wireless account. The speed in which a Refund reaches the Purchaser is dependent on Purchaser’s banking institution, and/or any other amounts owed by Purchaser to Orbitvu.
Governing Law and Dispute Resolution
The Purchaser agrees that this Return Policy is governed by New Jersey law. All legal proceedings arising out of or in connection with this Return Policy shall be brought solely in the venue and jurisdiction of Courts of Essex County, New Jersey, decided solely pursuant to New Jersey law, and Purchaser hereby waives all conflicts thereto. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. Orbitvu shall be entitled to all reasonable attorneys’ fees and court costs from Purchaser for any dispute whatsoever and/or any issues arising from this Orbitvu Return Policy, as well as interest from Purchaser of one and a half percent (1.5%) per month on any and all amounts owed to Orbitvu.
Amendments and Updates
Purchaser agrees that Orbitvu may amend and/or update all or any part of this Return Policy at any time in its sole discretion and without notice. Any amendments and updates to the Return Policy shall be effective upon publication on the Website. Please access the Return Policy on the Website regularly in order to check whether the Return Policy has been updated.
If any provision of any part of this Return Policy shall be deemed invalid, void, or unenforceable, Purchaser agrees that said provision shall be deemed severable (and shall be severed as narrowly as possible in order to still maintain the purpose and meaning) and shall not affect the validity and enforceability of the remaining Return Policy.
